Policy Regarding the Digital Millennium Copyright Act

Greetings to all visitors of this website (referred to as the ‘Site’). Here, we uphold and value the intellectual property rights of all individuals, just as we expect others to respect our own rights. In accordance with the Digital Millennium Copyright Act (DMCA), as stated in Title 17 of the United States Code, Section 512(c), a copyright owner or their representative can issue a takedown notice to us through our DMCA Agent, whose contact information is listed below. Being an internet service provider, we have the right to claim immunity from any infringement claims under the ‘safe harbor’ provisions of the DMCA. Any individual submitting an infringement claim must provide the following information in good faith:

Notice of Infringement – Claim

  1. A signature by the copyright owner or an authorized representative;
  2. Documentation of the copyrighted work alleged to be infringed;
  3. Identification of the infringing material to be removed, along with details to help locate the material (such as the URL of the page in question);
  4. Contact information of the complaining party, including name, address, email, phone, and fax number;
  5. A statement by the complaining party asserting unauthorized use of the material;
  6. A confirmation of the accuracy of the information provided, under penalty of perjury.

Section 17 USC §512(f) imposes penalties for misrepresentation in an infringement claim under 17 USC §512(c)(3), including civil damages and attorney fees.

Please be aware that we may share the identity and information in any copyright infringement claim with the alleged infringer. By submitting a claim, you acknowledge and accept that your identity and claim may be disclosed to the alleged infringer.

Counter Notification – Restoration of Material

If you receive a takedown notice for alleged copyright infringement, you can submit a counter notification to have the material restored on the site. The counter notification must be sent in writing to our DMCA Agent and include the following elements as per 17 USC Section 512(g)(3):

  1. Your signature, either physical or electronic.
  2. Details of the material taken down and its original location.
  3. A statement, under penalty of perjury, that the material was removed or disabled due to a mistake or misidentification.
  4. Your name, address, phone number, and consent to the jurisdiction of the federal district court.

Repeat Infringer Policy

We treat copyright infringement with utmost seriousness. Following the requirements of the DMCA, we keep a record of DMCA notices from copyright holders and make an effort to identify repeat infringers. Individuals violating our internal policy on repeat infringement will face account termination.
